What’s the Best Way to Search for a Conflict if I Have A Logo Mark?

If you have a logo what’s the best way to do a quick search for conflicting marks?

In order to search for logos that might conflict with your proposed trademark registration, you have to search the trademark database. But how can you find similar registered trademarks that might conflict with yours, when all you can do is say, “Well, my logo looks like this…” and describe your logo?

The answer is to use the Design Code Search Manual! The Design Code Search Manual contains codes for any element that you can describe in your logo. For example, if you have a lightning bolt in your logo, you would go to the manual and find the code that applies to your mark. There is a code for “Celestial Bodies and Natural Phenomena” where you will find codes for “lightening bolts.” Use the codes and sub-codes in the Manual to choose the appropriate category or subcategory for your logo.

Once you find the design code, you can use that code as a search term for your search using the Trademark Electronic Search System (TESS). To do a search, you will need to search using your design code, and then look at all the results (yes, it’s a little tedious) that your search returns. By looking at all the marks that have a lightening bolt in them, you’ll be able to see if any registered trademarks look “confusingly similar” to yours, and then you’ll know whether or not to apply for a registration for your logo.
